Existing Tennessee notaries can apply to become remote online notaries (RONs) via the Tennessee Secretary of State's website by reviewing the applicable statute and rules and providing the information below.

1. The name of your vendor and a description of the technologies it uses to provide the services listed in section 4;

Description of the technologies:

An electronic signature, or eSignature, is the broad umbrella category under which all electronic signatures fall. Digital signatures are a specific signature technology implementation of electronic signature.

Organizations typically refer to eSignature as the process a person goes through to demonstrate their intent during an electronic transaction, whereas a digital signature refers to the encryption technology containing critical metadata pertaining to the e-signature. The eSignature is the legally binding record, while the digital signature is the underlying technology that helps verify the transaction's authenticity.

Electronic signatures and their terminology are often region-specific as the technology has evolved differently in countries based on their purpose, underlying technology, and legal and cultural acceptance.

There are international regulations that help to standardize the terms and meanings of eSignatures. For example, eIDAS is an EU regulation on eSignatures for the European market.

Docusign Standards-Based Signatures is a core feature of Docusign’s platform that enables customers to enjoy the full range of Docusign Signature capabilities while staying compliant with local and industry e- signature standards. Similar to carrier-grade availability, Docusign Standards-Based Signatures is a platform feature that is available across all of Docusign’s applications and integrations. 

When referring to the process of electronically signing a document, it is recommended that the terms electronic signature or eSignatures are used. Digital Signatures should be used when referring specifically to electronic signatures that are signed using digital certificate technology.

 
2. An explanation of the method or technology you will use to maintain an electronic notary journal as required by the Rules;

Docusign Notary will electronically store the Journal plus Video recording of each Notarial session for 10 years with a tamper-evident seal. The Notary can access and download the artifacts via the Docusign Notary Dashboard.  Details on this process can be found here.

7.        JOURNAL AND RECORDING ACCESS AND STORAGE

7.1      Designation of Docusign for Storage. As Notary, you hereby designate Docusign to store on Docusign Notary the Journal and all Recordings for Sessions conducted by you during the Term. You further consent to your Employer, after any termination of your employment or engagement, being provided with a copy of such Journal and Recordings. Docusign does not serve as legal custodian for the Journal or the Recordings in providing storage services and assumes no fiduciary duties to you or to your Employer under these Service Terms.

7.2      Designation of Custodian. As Notary, you will promptly notify Docusign if you designate a custodian for the Journal or the Recordings and provide a copy of such designation in writing. If required by Notarial Law, you agree that you have informed the state commissioning agency of your appointment of a custodian. If you designate your Employer as custodian, your Employer will have read-only access to the Journal and Recordings from receipt by Docusign of the designation notice, and you agree that your Employer if permitted to release copies of any Journal entry or Recording in your written designation, will be authorized to do so on Docusign Notary. Additionally, upon any termination of your employment or revocation of your access to Docusign Notary, you agree that your Employer, as custodian, may maintain the Journal and Recordings on Docusign Notary to the extent permitted by Notarial Law. If Docusign is required by Notarial Law to store the Journal or the Recordings, and Docusign designates a custodian to provide such storage on its behalf. In that case, Docusign will notify the Notary of such designation. 


3. A copy of your unique electronic seal (see the Rules for requirements);

The Notary will use Docusign Notary to apply a digital signature using their digital certificate and add their Docusign generated Digital Notary seal to a sample document to upload to their TN account for verification.

4. A copy of your unique electronic notarial certificate that includes your electronic signature or other technology for rendering a notarized electronic document tamper-evident;

The Notary will use Docusign Notary to apply a digital signature using their digital certificate and add their Docusign generated Digital Notary seal to a sample document to upload to their TN account for verification.

5. A copy of the instructions or techniques supplied by the vendor allowing the online notary public’s electronic notarial certificate to be read and authenticated;

Docusign Notary allows a notary’s online notary public’s electronic notarial certificate to be read and authenticated using a signer-held digital certificate. Additional detail can be found on the following Docusign websites:


6. A copy of the instructions or techniques supplied by the vendor allowing the online notary public to conduct identity proofing and credential analysis.

Docusign Notary uses Credential Analysis (Drivers License or Passport photo) plus Identity Proofing using Knowledge-based Authentication (KBA). Additional details can be found on the Docusign Support site.
